Terms Of Event

Your agreement with us as a registrante and attendee of our Events. These terms were updated on 01 December 2019.

Definitions

These terms (“Terms,” “Agreement”) are an agreement between Garúa Milonguero, trading as TLC Encuentros Ltd (“Garúa Milonguero,” “us,” “we” or “our”), and you (“Participant”, “you” or “your”) and sets forth the terms of your participation in the registration and attendance to our Events. Participants are any persons in attendance or associated with our Events in any capacity, including attendees, members of the organising team and helper team, associated cleaners, drivers, security personnel and any other third-party service providers. Headings are for reference purposes only. A reference to a statute, code or other law includes regulations and other instruments under it and consolidations, amendments, re-enactments, or replacements of any of them. The singular includes the plural, and vice versa. Terms such as “includes” and “for example” are not words of limitation. A reference to the Terms incorporates by reference the Terms of Use, Códigos Codes of Conduct and the Privacy Policy.

Age requirement

You must be at least 18 years of age to register and attend our Events.

Registration categories

Leader: As a leader you are commiting to lead all or the majority of the time.

Follower: As a follower you are commiting to follow all or the majority of the time.

Dual Role Dancer: As a ‘Dual-Roler’ you are commiting to lead and follow on an approximate 50/50 basis. As a ‘Dual-Roler’ you can register as a single or in a couple but only in a couple with another Dual-Role dancer.

Registration on behalf of another

If you are registering on behalf of another person, it is your obligation to make sure that the person attending is aware of these Terms and accepts them. By completing and submitting the registration form you are representing and warranting that you have made the person attending aware of these Terms and that they have accepted these Terms.

Registration period

The period of time when registration is open and closed will be published on the Website. During this period logged-in users may access the registration form to begin the registration process.

Registration process

When you apply to attend our Event via the registration form on our website you will automatically receive a notification by email, via the email address you specified in the registration form, to advise you that we have received your application. Your application constitutes an offer made to us, to pay for, and attend, the Event specified in your registration form. We reserve the right to delay or refuse applications where the application contains incomplete details or details that cannot be verified or where fraud is suspected or where there is a clear conflict of interest.

Shortlisting and payment process

At registration closing, all applications will be considered without bias or discrimination, in the best interests of all other applicants and in alignment with our Codes of Conduct, collectively. We reserve the absolute right to accept or decline applications at any time and without explanation. If your application is successful, you will receive a confirmation email, including details of the Event, your personal reference number, and instructions to make payment by direct bank transfer. Your application is only accepted by us once we have emailed you, to confirm that your application is successful. Any items not included within the confirmation email are not included in the contract between you and us. If your application is unsuccessful, you will receive notification by email.

Ticketing

Your ticket remains our property and is a personal revocable license, which may be withdrawn, and admission to an Event may be refused at any time upon a refund. Refer to “Cancellations & Refunds.” Licence is not passed to you, the purchaser, until we have received and processed a valid payment, and that payment has been made into our own bank account and you have received confirmation that this payment has been received. Once we have received your payment, you will be sent a confirmation by email. This email contains your personal reference number and serves as both your purchase receipt and entry ticket to the Event.

Pricing

We will make every effort to ensure that the pricing displayed on our website is correct. However, if an error is found, we reserve the right to either cancel your registration or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of registrations can be cancelled or corrected by us at any time. We reserve the right to alter all pricing without notice.

Cancellations and refunds

You have a right to cancel. Tickets will only be cancelled and refunded on written request, within and up to 12 weeks prior to the Event start date. It is your responsibility to follow all instructions for requesting a return and refund as outlined herein. To cancel your ticket and/or request a refund, include in your email to us, your name, reference number, Event start date and the reason for the refund request. Subject to the above, a full refund of the purchase price will be made, by direct transfer, to the bank account you originally used to make the payment and within thirty days of receiving your written request.

Please note if you registered as a couple then if one party cancels both registrations are automatically cancelled. We will if this situation occurs give the other party a chance to find a suitable and agreed upon replacement but retain the right to cancel if this is not in a timely fashion.

Ticket transfers and reselling

Tickets, and their associated license, may not be transferred to any other person or third-party. The tickets you purchase are for your own personal use and may not be resold under any circumstances, including but not limited to use as part of any promotion or competition. Reselling or otherwise transferring your ticket, not in accordance with the Terms, will void the ticket and the ticket holder will not gain entry into the Event. Where there has been any resale or attempted resale of any tickets (or any other breach of this term), we reserve the right to cancel the relevant tickets with immediate effect. We reserve the right to cancel any ticket purchase made by any person or body whom we reasonably believe to be associated with any ticket re-selling or ticket broker.

Visa requirements

It is your sole responsibility to take care of your personal visa requirements. If you require an entry visa to attend our Event you must allow sufficient time for the visa application procedure. In the event you are not granted a visa, we are under no obligation to refund your ticket unless you are eligible to receive a refund. Refer to “Cancellations & Refunds”.

Admittance and exclusion

We, in our sole discretion, and without any liability or obligation to refund, reserve the right to refuse admittance to or to eject from the Event anyone that we determine (a) not invited to register (b) is behaving in a manner that could disrupt, hinder or cause a nuisance to other Participants; (c) represents a security or health & safety risk to the Event or other Participants or (d) fails to comply with, or is likely to fail to comply with, these Terms. Refer to our Codes of Conduct for information in relation to expected behaviours.

Programme changes and cancellations

Circumstances beyond our control may necessitate substitutions, alterations, postponements, or cancellations to the content, format, themes, name, performers, DJ’s, hosts, moderators, venue, or timing of an Event. We will endeavour to notify you as soon as reasonably practicable of any such changes by posting the updated information on our website. In the unlikely event of postponement or cancellation of an Event, our total aggregate liability to you is limited to the refund of paid fees that remain after credit card and payment processing fees have been incurred and deducted, and we will not be liable to you for any expenditure, damage or loss incurred by you as a result of the cancellation or postponement.

Travel and accommodation

Travel and accommodation are not included in the ticket price. Although we may undertake to suggest travel routes and hotels on our website, we are not, directly, or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with the organisations supplying these services nor do we assume any responsibility or liability for the actions, products and services or the consequences of these actions, products, and services. You are solely responsible for any travel and accommodation you undertake to purchase and make use of.

Participant identity

For security and identification reasons, we require all attendees to display on their wrist the official Event bracelet. Bracelets will be provided to you, at the venue reception, on the first day of your arrival. If you lose or damage your wristband, it is your responsibility to ask at reception for a replacement.

Health and safety

You are responsible for letting us know about any special health requirements, known medical conditions or providing us with an emergency contact name and phone number at the time of your registration. If you do provide this information, our responsibility is limited to passing this information on to qualified persons, such as the Police or Ambulance personnel, in an emergency. By registering to attend an Event you give express consent for us to relate this information to such personnel in any circumstance we deem, at our sole discretion, an emergency or where you are unable to do so yourself. You are responsible for arranging your own appropriate insurance cover in connection with your attendance at the Event. We and our related third-party service providers will not be liable for any injury or damage to any person or to any real or personal property howsoever caused (except for death or personal injury as a result of our negligence or for any other type of liability that cannot by law be excluded or limited).

Covid requirements

At the time of the event, we will be in compliance with the Government Health Guidelines for hosting an event. Closer to the time of the event we will advise all participants of the minimum entry requirements. Regardless of this, all Participants will be expected upon arrival at a minimum to have either an approved Vaccine Certificate with QR code or a negative PCR test with QR code not older than 72 hours. We reserve the right to insist on antigen testing if the regulations at the time require it for entry. This will be done on site at registration. We also reserve the right to refuse entry to any participant who does not meet these minimum standards. Whilst it is highly likely that restrictions will be relaxed with summer, all participants must realise that compliance and safety of all dancers is paramount.

Accessibility

There is wheelchair access to the key areas inside the venue and campus. Seating will be available to participants. You are responsible for letting us know about any special access requirements at the time of your booking. To ensure we have sufficient time to accommodate your needs, requests must be made at least three weeks prior to the conference. If you have not advised us of your requirements at least three weeks in advance of the Event, we cannot guarantee that we can meet them.

Car parking

Car parking space is available on site. You may park your car, free of charge, within the allocated area. You are solely responsible for the safety of your car and damage, loss or theft incurred as a consequence. If you are selecting the on-campus accommodation for your parking, there is free long-term parking near your apartments. We would advise walking to the venue from here when dancing.

Parties

Informal parties organised by us and held prior to or after the main Event are not included in the ticket price. Entry requirements are published on our website and Participants are required to adhere to these terms in their entirety. Informal parties that take place in the campus accommodation are not part of this event or associated with it in any way.

Raffle, snacks and drinks

There will be a range of free snacks and nibbles at all the milongas, some healthy, some naughty. Non-alcoholic drinks will also be available throughout the Event to all Participants free of charge. Alcoholic drinks are not for sale at the event. Participants who purchase a raffle ticket will also receive complimentary vouchers which can be used to obtain free drinks from the bar. Raffle tickets are available at the venue reception throughout the weekend. The raffle winner will be announced on the final day of the Event using a fair and anonymous means of selection. If the winner is not present, he/she will be notified by email. We reserve the right to select the means of drawing the winner or cancel the raffle at any time.

Photography and other media

By attending the Event you acknowledge and agree that the Event (or any part of it) may be photographed or recorded by us or our Participants. You agree to permit us, or any third party licensed by us, to use, distribute, broadcast, or otherwise globally disseminate your likeness, name, voice and words in perpetuity in television, radio, film, newspapers, magazines and other media now available and hereafter developed, both before, during and any time after the Event, and in any form, without any further approval from you or any payment to you. This grant includes, but is not limited to, the right to edit the media, the right to use the media (alone or together with other information), and the right to allow others to use or distribute the media.

Canvassing and promotions

Attendees shall not canvass, promote, advertise, or solicit for business in a manner which, in our sole discretion, is deemed unacceptable. We reserve the right to remove from the venue any attendee, who we consider to be canvassing, promoting, advertising, or soliciting for business.

Pets and other animals

Pets are not permitted anywhere in the venue or surrounding venue grounds.

Helper shifts and compensation

An agreement will be made between you, the accepted Helper, and us prior to the event. This agreement will clarify your availability during the Event, the number of shifts you will complete, a general description of your duties and the compensation you will receive from us. Once compensation is agreed, you will receive a discount, if you have not yet purchased your ticket, or a refund, if you have already purchased your ticket.

Helper conduct

Helpers who violate any of these Terms, behave in a manner that could be disruptive to the Event or any other Participant, Team Member, Helper or any other third-party service provider, consume alcohol and/or illegal substances before or while on duty, or fail to show up for an assigned shift may be stripped of their credentials, denied access to the Event and Event grounds.

Notifications and communications

We do our best to keep our website updated and provide you with Services to help you receive communications in a timely manner. It is your responsibility to update your personal email application settings to accept our email address, info@garua-milonguero.com , in order to receive important Event related notifications during the registration and ticketing process, before, during and after the Event. If you do not receive any notifications after registering on our site or subscribing to our mailing list, it is your responsibility to inform us.

Intellectual property rights

All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event are owned by us. You must not reproduce or allow anyone one to reproduce trademarks or materials distributed by or on behalf of us at an Event for any reason, without our prior written permission. Nothing in these Terms shall vest in you any legal or beneficial right in or to any intellectual property rights owned or used under licence by us or grant to you any right or licence to any other intellectual property rights of us. All such intellectual property rights shall remain the exclusive property of us. It is strictly forbidden for any company, organisation, or person to attempt to host or organise any event in conjunction with, contiguous to or purporting to be related to an Event or its affiliates without the express prior permission and cooperation of us. We reserve their right to take such action (legal or otherwise), including a claim for damages as we, in our sole discretion, deem appropriate in the circumstances.

Warranties

To the extent permitted by the applicable law, we disclaim all warranties or conditions, either express or implied, or any part of them in respect of any aspect of an Event or any related materials. You acknowledge and agree that in accepting these Terms you have not relied on any representation or warranty that is not expressly included in these Terms, and you agree that you shall have no remedy in respect of any misrepresentation which has not become a part of these Terms.

Limitation of liability

Materials shared or distributed at or in connection with an Event are intended for information purposes only and should not be relied upon by you or others. We do not provide any guarantees, conditions, or warranties that the materials are complete or accurate and do not accept any responsibility or liability for reliance by you or any person on any aspect of the Event and/or any information provided at the Event. To the fullest extent allowed by applicable law, we shall not be liable to you whether in contract, tort (including for negligence), misrepresentation, restitution or otherwise for any loss of profits, sales or business, agreements or contracts, anticipated savings, income, opportunity, loss of or damage to goodwill, use or corruption of software, data or information, and/or similar losses or pure economic loss, or for any indirect or consequential loss, costs, damages, charges or expenses however arising under or in connection with the performance or contemplated performance of the Terms, even if we had been advised of the possibility of same in advance and subject to these Terms, our total aggregate liability in contract, tort (including negligence), misrepresentation, restitution or otherwise, arising under or in connection with the performance or contemplated performance of the Terms is limited to the total amount paid by you to us for your ticket to attend the Event, after the payment of any processing fees or bank charges where applicable. Nothing in these Terms purports to exclude or limit liability for any fraudulent statement or act or in respect of any liability that cannot excluded or limited under applicable law.

Indemnity

You agree to defend, indemnify, and hold us, our related companies, affiliates, subsidiaries, joint ventures, third-party service providers, and our respective employees, contractors, agents, officers, and directors harmless from all claims, liability, damages, losses, costs and expenses, including legal fees, that arise out of or are related to any breach of the Terms by you or any other liabilities incurred by us arising out of your attendance or participation at an Event.

Forces beyond our control

We are not liable if an Event is, in whole or in part, cancelled, rescheduled or postponed, or for any failure or delay to perform our obligations under these Terms, if such event results from anything beyond our reasonable control (for example, natural disasters, flood, fire, acts of terror, labour strike, extreme weather malicious damage, compliance with any law or governmental order, or mechanical, electronic or communications failure or degradation, or any other emergency) or anything else that renders performance of an Event, in whole or in part, impracticable, illegal or impossible.

Governing law and jurisdiction

These Terms, your use of the Site and your use of the Services, shall be governed by and construed in accordance with Irish law and the Irish Courts shall have exclusive jurisdiction over any dispute which may arise. Any contractual or legal relationship between you and us will be concluded in English. Nothing contained in the Terms shall limit our right to bring enforcement proceedings in another jurisdiction or to seek interim, protective or provisional relief in the courts of another jurisdiction. If a court with jurisdiction over these Terms finds that any part of these Terms is wholly or partly unenforceable, you and we agree that where possible, the court should modify the terms to make that part enforceable while still achieving its intent. If the court cannot do that, you and we agree that the court should not have regard to that unenforceable part but still enforce the rest of these Terms. To the extent allowed by law, the English language version of the Terms is binding, and any translations are for convenience only.

Failure to enforce

If we fail to insist that you perform any of your obligations under these Terms or, we do not act or delay in acting to exercise a right or remedy provided by these Terms, that does not mean we have waived our rights or remedies against you and will not mean that you do not have to comply with your obligations.

Partnership

You and we agree that no agency, partnership, joint venture, or employment is created as a result of these Terms, and you do not have any authority of any kind to bind us in any respect.

Data protection

We take your privacy seriously and confirm that we will not rent or sell any private data submitted by Participants without the Participant’s express prior approval. Please see our Privacy Policy which explains how we collect, store, share and process private data and your legal rights.

Amendments

We reserve the right to modify this Agreement or its policies relating to the Website or Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will revise the updated date at the top of this Agreement. Continued use of the Website after any such changes shall constitute your consent to such changes.

Acceptance of these terms

These Terms including the aforementioned Codes of Conduct, Terms of Use and Privacy Policy, contain the entire agreement and understanding between us and supersede any prior, written or oral agreement between us relating to such matters. You confirm that in agreeing to accept these Terms you have not relied on any representation that is not expressly included herein, and you agree that you shall have no remedy in respect of any misrepresentation which has not become a part of these Terms. However, nothing in these Terms purports to exclude liability for any fraudulent statement or act. By registering for the Event, you agree that you have read and accepted these Terms and agree to be legally bound by them. If you do not wish to be bound by these Terms, please do not register, attend, or participate in the Event.
